Can I take a roommate to small claims?
I'll try to keep this short. I live in NY in a 2 bedroom apartment. A friend and his dog needed a place to stay for a couple months till he found a new place and agreed to pay half the rent. Its been 5 months now and my apartment is ruinned. The dog pissed and shit everyday on my new couches and carpets, he has been sleeping on my livingroom couch and stinking it up despite having the second bedroom I offered him. My computer had such a nasty virus on it from him downloading porn that it was unrepairable and he refused to pay half for that. He just moved out and didn't pay this months rent. My couches and carpets need to be replaced before my Landlored sees or smells them and i'm out computer and rent money. Can I go to smal claims court???
Absolutely, but be sure to have all evidence (pictures, witnesses, etc.) with you when you go to court.
